Q: I'm about 34 weeks pregnant and live in Califronia. I work for a small company for 2 years and told them I was pregnant the first month. I plan on going on maternity leave when I am 37 weeks, but they are already replacing me. They took away my position and gave it to a new hire and I am now doing small jobs that I did when I first started working here before I got promoted. I also recently found out that they are planning on asking a lawyer about letting me go. If this happens is it legal and what can I do about me health insurance? Please anybody give me feedback.
A: It pretty much all depends on your job. One of the major things is how long you've been there. First off they can not fire you because you are pregnant that would be discrimination. However there are plenty of ways to get around "letting you go" by doing as they have already done. All jobs are created differently and have established different rules when it comes to maternity leave. My sister works for the post office and after a year she is allowed 3 mths leave WITHOUT PAY however she gets to keep her position. At my old job if you didn't work there for at least a year there was no maternity leave and no guarantee to get your job back. Every place is different. If you really want to keep your job, which I wouldn't if they were going to treat me like that after two years! Then I would get a free consultation with a lawyer and see what they have to say.
